1. Who you are contracting with

These terms are an agreement between you and Spanory ("Spanory", "we", "us"), a missed-call lead recovery service operated by Romaine Falconer, a sole trader trading as Spanory, whose registered address is Seaview District, Southfield, P.O., Jamaica. By creating an account or continuing to use the service you agree to these terms. If you use Spanory on behalf of a business, you confirm you have authority to bind that business; otherwise you confirm you are of legal age to contract.

2. The service

Spanory detects missed calls to your business, sends automated text replies, qualifies leads with AI assistance, helps book appointments, follows up and reports recovered revenue. Spanory sits alongside your existing phone, CRM and dispatch tools; it does not replace them. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you select.

3. Your account

You must provide accurate information and keep it up to date, keep your credentials confidential, and you are responsible for all activity under your account.

4. Acceptable use

  • No unlawful use, fraud, spam or messaging to people who have not consented or who have opted out.
  • No infringement of anyone's intellectual property or privacy rights.
  • No interference with the security of the service: malware, probing, scraping or circumventing technical limits.
  • No reverse engineering, resale or redistribution of the service.
  • You are responsible for complying with telecom and messaging rules that apply to your business, including consent and opt-out handling.

5. AI-generated content

  • Spanory uses AI to draft replies and summarise conversations. Outputs may be inaccurate or incomplete and are not professional, legal, financial or safety advice.
  • You are responsible for the instructions, templates and business information you supply, for having the rights to that content, and for reviewing how outputs are used with your customers.
  • You must not use the service to generate illegal content, deceptive impersonation, hate speech, malware, or to attempt to bypass safety controls.
  • You retain rights in the content you provide and in the outputs generated for your business, subject to these terms. Rights holders can contact us at support@spanory.com to report infringing content; we may remove it and we may terminate accounts for repeat infringement.
  • We may filter, restrict or refuse outputs, and remove content, to keep the service safe and lawful.

6. Your content

You keep ownership of your business data, leads and messages. You grant us a limited licence to host and process that content solely to provide and support the service.

7. Intellectual property

Spanory retains all rights in the service, its software, documentation and branding. Nothing in these terms transfers that ownership to you.

8. Payment and subscriptions

Subscriptions are billed monthly in advance for the plan you choose. Payment, billing, tax, cancellation and refund mechanics are handled by our reseller under the Paddle Buyer Terms. Text and phone usage charges from your phone provider are billed separately by that provider.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Service level

We work to keep Spanory available, but we do not guarantee uninterrupted or error-free performance. Maintenance, third-party outages and network issues may affect the service.

10. Warranties and liability

To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including lost profits, lost data or lost goodwill. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury where the law does not allow it.

11. Indemnity

You will indemnify Spanory against claims arising from your content, your unlawful use of the service, or your breach of these terms.

12. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time; access continues until the end of the period you have paid for. After termination you may request an export of your data for 30 days, after which it may be deleted.

13. General

We may update these terms and will post the new version here. You may not assign this agreement without our consent; we may assign it in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the jurisdiction in which Spanory is established, and disputes will be heard by the courts of that jurisdiction.
